By downloading, installing, registering, or using Growy Brain (the "App"), you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree to these terms, please do not use the application.

These Terms constitute a legally binding agreement between you and Growy Brain. By creating an account, you represent and warrant that you are at least 14 years old and have the legal capacity to enter into this agreement.

2. Description of Service

Growy Brain is a mobile application that provides memory and cognitive training games. The App requires an internet connection for account creation, authentication, leaderboards, and data synchronization. Some features may be available offline, but full functionality requires internet connectivity.

The App includes features such as:

• Memory and cognitive training games
• User profiles and progress tracking
• Leaderboards and rankings
• Daily challenges and achievements

3. Account Registration and Security

To use certain features of the App, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. We are not liable for any loss or damage arising from your failure to protect your account information.

4. Age Requirements and Eligibility

Growy Brain is intended for users aged 14 years and older. By using the App, you represent and warrant that:

• You are at least 14 years old
• You have the legal capacity to enter into this agreement
• You will provide accurate date of birth information during registration
• If you are between 14 and 18 years old, you have obtained parental or guardian consent to use the App

We reserve the right to verify your age and may suspend or terminate accounts that violate age requirements.

5. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Using the App for any illegal purpose or in violation of any laws
• Attempting to gain unauthorized access to the App, user accounts, or computer systems
• Interfering with or disrupting the App's servers or networks
• Using automated systems (bots, scripts) to access or use the App
• Cheating, exploiting bugs, or using unauthorized third-party software
• Impersonating another user or entity
• Harassing, threatening, or abusing other users
• Sharing inappropriate, offensive, or illegal content
• Reverse engineering, decompiling, or disassembling the App
• Modifying, copying, or creating derivative works of the App
• Removing or altering any copyright, trademark, or other proprietary notices

6. Intellectual Property Rights

The App and all content, features, graphics, code, trademarks, logos, and other materials are owned by Growy Brain or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include:

• Any right to resell or redistribute the App
• Any right to modify or create derivative works
• Any right to use our trademarks or logos
• Any right to access source code or underlying technology

7. User-Generated Content

The App allows you to create and customize your profile, including choosing a mascot name. You retain ownership of any content you create, but you grant us a worldwide, royalty-free, non-exclusive license to use, display, and distribute your content in connection with the App.

You represent and warrant that your content:

• Does not infringe any third-party rights
• Is not illegal, offensive, or harmful
• Does not contain personal information of others without consent
• Complies with these Terms and applicable laws

We reserve the right to remove or modify any content that violates these Terms or is otherwise objectionable.

8. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you consent to our Privacy Policy and data practices as described therein.

The App complies with the General Data Protection Regulation (GDPR) and other applicable data protection laws. For more information about how we handle your data, please review our Privacy Policy.

9. Account Termination

You may terminate your account at any time by contacting us at info@growybrain.com or using the account deletion feature in the App settings.

We reserve the right to suspend or terminate your account immediately, without prior notice, if you:

• Violate these Terms or our Privacy Policy
• Engage in fraudulent, illegal, or harmful activities
• Provide false or misleading information
• Are under the age of 14
• Otherwise abuse or misuse the App

Upon termination, your right to use the App will cease immediately. We may delete your account and data in accordance with our Privacy Policy and applicable laws.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Defects will be corrected
• The App is free of viruses or other harmful components
• The App will meet your requirements or expectations

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE APP.

Our total liability for any claims arising from or related to the App shall not exceed €50.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless Growy Brain, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or relating to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of another party
• Your user-generated content

13. Changes to Terms

We reserve the right to modify these Terms and Conditions at any time. We will notify you of material changes by:

• Displaying a notice in the App
• Updating the "Last Updated" date
• Sending an email notification (if you have provided an email address)

Your continued use of the App after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the App and may terminate your account.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.

For users in the European Union, these Terms are subject to EU consumer protection laws. If you are a consumer in the EU, you may have additional rights under your local consumer protection laws.

Any disputes arising from or relating to these Terms or the App shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiations, it shall be subject to the exclusive jurisdiction of the courts of Italy.

15. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be replaced with a valid provision that most closely reflects the intent of the original provision.

16. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Growy Brain regarding your use of the App and supersede all prior agreements and understandings.

Scaricando, installando, registrandoti o utilizzando Growy Brain (l'"App"), accetti di essere vincolato da questi Termini e Condizioni e dalla nostra Informativa sulla Privacy. Se non accetti questi termini, ti preghiamo di non utilizzare l'applicazione.

Questi Termini costituiscono un accordo legalmente vincolante tra te e Growy Brain. Creando un account, dichiari e garantisci di avere almeno 14 anni e di avere la capacità legale di stipulare questo accordo.

2. Descrizione del Servizio

Growy Brain è un'applicazione mobile che fornisce giochi di memoria e allenamento cognitivo. L'App richiede una connessione internet per la creazione dell'account, l'autenticazione, le classifiche e la sincronizzazione dei dati. Alcune funzionalità possono essere disponibili offline, ma la funzionalità completa richiede la connettività internet.

• Sfide giornaliere e achievement

3. Registrazione Account e Sicurezza

Per utilizzare determinate funzionalità dell'App, devi creare un account. Creando un account, accetti di:

• Fornire informazioni accurate, attuali e complete
• Mantenere e aggiornare le tue informazioni per mantenerle accurate
• Mantenere la sicurezza delle credenziali del tuo account
• Accettare la responsabilità per tutte le attività che si verificano sotto il tuo account
• Notificarci immediatamente di qualsiasi uso non autorizzato del tuo account

Sei responsabile di mantenere la riservatezza della password del tuo account e di tutte le attività che si verificano sotto il tuo account. Non siamo responsabili per eventuali perdite o danni derivanti dalla tua incapacità di proteggere le informazioni del tuo account.

4. Requisiti di Età ed Eleggibilità

Growy Brain è destinata a utenti di età pari o superiore a 14 anni. Utilizzando l'App, dichiari e garantisci che:

• Hai almeno 14 anni
• Hai la capacità legale di stipulare questo accordo
• Fornirai informazioni accurate sulla data di nascita durante la registrazione
• Se hai tra 14 e 18 anni, hai ottenuto il consenso dei genitori o del tutore per utilizzare l'App

Ci riserviamo il diritto di verificare la tua età e possiamo sospendere o terminare gli account che violano i requisiti di età.

5. Comportamento dell'Utente e Attività Vietate

Accetti di non impegnarti in nessuna delle seguenti attività vietate:

• Utilizzare l'App per scopi illegali o in violazione di qualsiasi legge
• Tentare di ottenere accesso non autorizzato all'App, agli account utente o ai sistemi informatici
• Interferire o interrompere i server o le reti dell'App
• Utilizzare sistemi automatizzati (bot, script) per accedere o utilizzare l'App
• Barare, sfruttare bug o utilizzare software di terze parti non autorizzato
• Impersonare un altro utente o entità
• Molestare, minacciare o abusare di altri utenti
• Condividere contenuti inappropriati, offensivi o illegali
• Fare reverse engineering, decompilare o smontare l'App
• Modificare, copiare o creare opere derivate dell'App
• Rimuovere o alterare eventuali avvisi di copyright, marchio o altri avvisi proprietari

6. Diritti di Proprietà Intellettuale

L'App e tutti i contenuti, funzionalità, grafica, codice, marchi, loghi e altri materiali sono di proprietà di Growy Brain o dei suoi licenzianti e sono protetti da copyright, marchio e altre leggi sulla proprietà intellettuale.

Ti viene concessa una licenza limitata, non esclusiva, non trasferibile, revocabile per utilizzare l'App per scopi personali, non commerciali in conformità con questi Termini. Questa licenza non include:

• Qualsiasi diritto di rivendere o ridistribuire l'App
• Qualsiasi diritto di modificare o creare opere derivate
• Qualsiasi diritto di utilizzare i nostri marchi o loghi
• Qualsiasi diritto di accedere al codice sorgente o alla tecnologia sottostante

7. Contenuti Generati dall'Utente

L'App ti consente di creare e personalizzare il tuo profilo, incluso scegliere un nome mascot. Mantieni la proprietà di qualsiasi contenuto che crei, ma ci concedi una licenza mondiale, gratuita, non esclusiva per utilizzare, visualizzare e distribuire i tuoi contenuti in connessione con l'App.

Dichiari e garantisci che i tuoi contenuti:

• Non violano alcun diritto di terze parti
• Non sono illegali, offensivi o dannosi
• Non contengono informazioni personali di altri senza consenso
• Conformi a questi Termini e alle leggi applicabili

Ci riserviamo il diritto di rimuovere o modificare qualsiasi contenuto che viola questi Termini o è altrimenti discutibile.

8. Privacy e Protezione dei Dati

La tua privacy è importante per noi. La nostra raccolta, utilizzo e protezione dei tuoi dati personali è disciplinata dalla nostra Informativa sulla Privacy, che è incorporata in questi Termini per riferimento. Utilizzando l'App, acconsenti alla nostra Informativa sulla Privacy e alle pratiche sui dati come descritto in essa.

9. Terminazione dell'Account

Puoi terminare il tuo account in qualsiasi momento contattandoci a info@growybrain.com o utilizzando la funzione di eliminazione dell'account nelle impostazioni dell'App.

Ci riserviamo il diritto di sospendere o terminare il tuo account immediatamente, senza preavviso, se:

• Violi questi Termini o la nostra Informativa sulla Privacy
• Ti impegni in attività fraudolente, illegali o dannose
• Fornisci informazioni false o fuorvianti
• Hai meno di 14 anni
• Altrimenti abusi o usi impropriamente l'App

Al momento della terminazione, il tuo diritto di utilizzare l'App cesserà immediatamente. Possiamo eliminare il tuo account e i dati in conformità con la nostra Informativa sulla Privacy e le leggi applicabili.

10. Esclusione di Garanzie

L'APP È FORNITA "COSÌ COM'È" E "COME DISPONIBILE" SENZA GARANZIE DI ALCUN TIPO, SIA ESPRESSE CHE IMPLICITE, INCLUSO MA NON LIMITATO A GARANZIE DI COMMERCIABILITÀ, IDONEITÀ PER UNO SCOPO PARTICOLARE, NON VIOLAZIONE O PRECISIONE.

Non garantiamo che:

• L'App sarà ininterrotta, sicura o priva di errori
• I difetti saranno corretti
• L'App è priva di virus o altri componenti dannosi
• L'App soddisferà i tuoi requisiti o aspettative

11. Limitazione di Responsabilità

NELLA MISURA MASSIMA CONSENTITA DALLA LEGGE APPLICABILE, NON SAREMO RESPONSABILI PER EVENTUALI DANNI INDIRETTI, INCIDENTALI, SPECIALI, CONSEGUENZIALI O PUNITIVI, INCLUSO MA NON LIMITATO A PERDITA DI PROFITTI, DATI, UTILIZZO, AVVIAMENTO O ALTRE PERDITE IMMATERIALI, DERIVANTI O RELATIVI AL TUO UTILIZZO DELL'APP.

La nostra responsabilità totale per eventuali reclami derivanti o relativi all'App non supererà €50.

Alcune giurisdizioni non consentono l'esclusione o la limitazione di determinati danni, quindi alcune delle limitazioni sopra indicate potrebbero non applicarsi a te.

12. Indennizzo

Accetti di indennizzare, difendere e tenere indenne Growy Brain, le sue affiliate, funzionari, direttori, dipendenti e agenti da eventuali reclami, danni, perdite, responsabilità e spese (inclusi gli onorari legali) derivanti o relativi a:

• Il tuo utilizzo dell'App
• La tua violazione di questi Termini
• La tua violazione di qualsiasi diritto di un'altra parte
• I tuoi contenuti generati dall'utente

13. Modifiche ai Termini

Ci riserviamo il diritto di modificare questi Termini e Condizioni in qualsiasi momento. Ti notificheremo eventuali modifiche sostanziali mediante:

• Visualizzazione di un avviso nell'App
• Aggiornamento della data "Ultimo aggiornamento"
• Invio di una notifica email (se hai fornito un indirizzo email)

Il tuo continuo utilizzo dell'App dopo che le modifiche diventano effettive costituisce accettazione dei Termini aggiornati. Se non accetti le modifiche, devi smettere di utilizzare l'App e puoi terminare il tuo account.

14. Legge Applicabile e Risoluzione delle Controversie

Questi Termini saranno governati e interpretati in conformità con le leggi dell'Italia, senza riguardo alle sue disposizioni sul conflitto di leggi.

Per gli utenti nell'Unione Europea, questi Termini sono soggetti alle leggi sulla protezione dei consumatori dell'UE. Se sei un consumatore nell'UE, potresti avere diritti aggiuntivi ai sensi delle tue leggi locali sulla protezione dei consumatori.

Eventuali controversie derivanti o relative a questi Termini o all'App saranno risolte attraverso negoziazioni di buona fede. Se una controversia non può essere risolta attraverso negoziazioni, sarà soggetta alla giurisdizione esclusiva dei tribunali dell'Italia.

15. Separabilità

Se qualsiasi disposizione di questi Termini risulta essere invalida, illegale o non applicabile, le disposizioni rimanenti rimarranno in pieno vigore ed effetto. La disposizione invalida sarà sostituita con una disposizione valida che riflette più da vicino l'intento della disposizione originale.

16. Accordo Completo

Questi Termini, insieme alla nostra Informativa sulla Privacy, costituiscono l'intero accordo tra te e Growy Brain riguardo al tuo utilizzo dell'App e sostituiscono tutti gli accordi e le comprensioni precedenti.
